Nick Farley, President of Nick Farley & Associates, Inc., was invited to speak at the National Indian Gaming Commission Public Hearing on the proposed “Class II Definitions and Classification Standards” for Indian gaming on September 19, 2006.  Nick Farley addressed the Commission and public audience as a part of the panel comprised of State Governments and Testing Labs.  The audience consisted of gaming industry veterans representing the government, legal, and manufacturing aspects of the trade, as well as the public.  Nick Farley expressed his professional opinions on the proposed Classification Standards for Class II gaming.  Specifically addressed were issues in which the proposed standards contradict current NIGC Advisory Opinions on Class II Bingo systems.  Nick Farley also spoke on electronic pull tab systems, pointing out the possibility of a monopolization of the market under the newly proposed guidelines.

Nick Farley spoke on behalf of Nick Farley & Associates, Inc. to also shine a light on some issues that may have been overlooked by the law enforcement and governmental point of view.  As one of only two speakers representing independent regulatory compliance test labs, Nick Farley’s testimony pointed out the plight that law enforcement agencies must face as technology blurs the line between Class II and Class III gaming; and offered his opinions on the Proposed Classification Standards keeping this difficult situation in mind.  “Having been selected to speak on the panel of State Governments and Testing Labs before the NIGC is a testament to the respect that Nick Farley & Associates has earned as one of the industry’s best independent compliance testing laboratories and consulting agencies” stated Nick Farley, President.  “We have been working with the National Indian Gaming Commission for many years, and have been a testing laboratory upon which they have relied for candid and impartial assessment of gaming equipment of which they have rendered a Classification opinion upon.”  The NIGC was established under the Indian Gaming Regulatory Act of 1988 to oversee selected gaming activities in Tribal lands.  The NIGC has relied upon NFA in its efforts to uphold the integrity and honesty of Tribal gaming.

Nick Farley & Associates Onsite Verification at Will Rogers Downs Shows Efficiency Over Competition

On Thursday, April 13, 2006, Cherokee Casinos’ Will Rogers Downs in Claremore, Oklahoma enlisted Nick Farley & Associates, Inc. to conduct an onsite review and examination of 101 VGT Live Call Bingo Bonanza Bingo player terminals and the respective system server.  The purpose of this inspection was to assure that the installed games and servers were properly operating with the correct software versions that had heretofore been approved by Nick Farley & Associates, Inc.  All player terminals were tested for proper communication to ensure that all accounting and security information was being transmitted correctly.  Previously, a competing independent test laboratory performed a similar onsite inspection which required the use of four employees over four days in order to complete an inspection of 250 machines.  Nick Farley & Associates, Inc. was able to complete the same type of inspection for 101 machines using only two employees in one day.

“The quick yet efficient manner of testing, that our clients have come to appreciate and expect of Nick Farley & Associates, Inc., was highlighted during this onsite inspection.  Following a competitor’s completed examination gave us a chance to showcase, in comparison, our proficient testing procedures.  This is the second time that we have been able to conduct such a thorough, yet efficient examination of gaming equipment in just one day.  Our swift turnaround time, and impeccable testing results, clearly reflects our ability to compete among our peers, and that competition breeds improvements and efficiencies in testing.  ” stated Nick Farley, President.

Nick Farley & Associates Successful Onsite Inspection Completed in Only One Business Day

Nick Farley & Associates, Inc. conducted an onsite review and examination of 100 VGT Live Call Bingo Bonanza Bingo player terminals and their respective system server on Thursday, March 30, 2006 at the Choctaw Nation’s Blue Ribbon Downs Racino (BRD) in Sallisaw, Oklahoma.  The scope of this assessment was to assure that the games and servers installed on the property were properly operating with the approved software versions that had been previously authorized by Nick Farley & Associates, Inc. under the Rules for Racetrack Gaming promulgated by the Oklahoma Horse Racing Commission (OHRC).  Additionally, the player terminals being examined underwent communication testing to assure the proper transmission of security and accounting information to the system server.  A similar examination of 250 devices had been recently undertaken at this facility by a competing independent test laboratory using four staff members over a period of four days.  Having brought in only two employees and finishing their inspection in one business day, Nick Farley & Associates, Inc. completed their inspection of 100 games and the respective server in one-quarter of the time and engaging only half the staff of their competition.

“Two NFA employees worked with OHRC staff and BRD staff to conduct this inspection.  We began the inspection around 9AM, trained the OHRC staff on the use and operation of the FileCheck software verification tool, conducted the inspection, and had received authorization from the OHRC to allow the games to go live before 5:30PM on the same day.  Such an efficient inspection is unprecedented!  Nick Farley & Associates, Inc. is excited to be able to offer our clients efficient and top quality testing services that stand out among our industry peers.  Our swift, yet thorough, examination is a strong proponent to our credibility in an industry in which integrity is a valuable and necessary asset.” stated Nick Farley, President.
